Terms of Service

These Terms of Service ('Terms') are an agreement between you and Yehor Hunko, a private entrepreneur (ФОП) registered in Ukraine ('Nutly', 'we', 'us'). They govern your use of the Nutly app and website.

By using Nutly, you agree to these Terms and to our Privacy Policy. If you don't agree, please don't use Nutly. We've written these Terms in plain language — and nothing in them takes away rights you have under mandatory consumer law.

Who we are

Nutly is operated by Yehor Hunko, a private entrepreneur (ФОП) registered in Ukraine. You can contact us about these Terms at privacy@nutly.cc.

Who can use Nutly

You must be at least 16 years old and meet any higher minimum age that applies where you live to use Nutly.

Some features, including label uploads and personal analysis, require the account that the app registers automatically after onboarding when it connects. You do not need to fill in a registration form. Features may be limited or change as we develop the app.

What Nutly does

Nutly helps you understand what's in packaged food. You scan a barcode; Nutly looks the product up, and if it isn't found you can photograph the ingredients label so we can read it. Nutly then identifies ingredients and additives and gives a health-related score.

We're still building Nutly, so features may change and the underlying data and scores will improve over time.

Information only — not medical or dietary advice

Nutly is for general information only. It is not medical, nutritional, or dietary advice, and it is not a substitute for reading the product's own label or speaking to a qualified professional.

Scores, ingredient readings, and additive information are generated automatically — including by optical character recognition and AI — and drawn from external databases, so they can be incomplete, out of date, or wrong. Always check the actual product packaging.

Never rely on Nutly for decisions about allergies, intolerances, medical conditions, or anything where a mistake could harm your health. If you have a food allergy or a medical condition, follow the product label and your healthcare provider — not Nutly.

Your account

Nutly creates a random, pseudonymous account for your device and registers it automatically after onboarding when it connects. You do not need to provide a name, email or password. Your subscription, usage limits, reports and health profile, if you save one, are linked to this account.

On iOS, account credentials are kept in iCloud Keychain and can carry over to your other Apple devices and a reinstall when you use the same iCloud account with Keychain enabled. On Android, account credentials are encrypted with an Android Keystore key and excluded from backup; they do not sync between devices or across platforms. Restore purchases may restore a subscription according to the store's rules; it does not restore your health profile or sync history across platforms. Keep your device secure, because someone with access to it can use your account. You can erase the account in Settings ('Erase my data') when connected to the internet. Deletion limits are explained in our Privacy Policy.

Using Nutly responsibly

Please use Nutly fairly and lawfully. In particular, don't: break the law or infringe anyone's rights; access the service in unauthorised ways or try to break its security; reverse-engineer, copy, or resell the app; use bots, scrapers, or automated tools to harvest data or place excessive load; upload malware; or interfere with how Nutly works for other people.

Photos and reports you submit

When you submit a label photo or a product report, you confirm that you're allowed to share it and that it doesn't contain other people's personal data.

Label photos are processed to recognise and check ingredients, nutrition and other product information. Temporary device files and AI-provider retention are explained in our Privacy Policy. Extracted and derived product information is saved in our shared catalogue, can appear on public product pages, and can remain after account erasure. Nutly does not save uploaded image bytes in its product or report database. Reports contain text and are kept so we can review and improve product data.

By submitting these contributions, you give us a worldwide, royalty-free licence to use them and the resulting product information to operate and improve Nutly, including its shared catalogue and public product pages. You keep ownership of what you submit.

Our content and intellectual property

Nutly — including the app, its design, the scoring method, and the Nutly name and logo — belongs to us or our licensors. We give you a personal, non-exclusive, non-transferable, revocable licence to use Nutly for your own, non-commercial purposes. We keep all rights we don't expressly grant you.

Third-party data and services

To identify and describe products, Nutly uses external sources, including Open Food Facts (made available under the Open Database License) and GS1 Ukraine. Data from these sources belongs to them, is subject to their own terms and licences, and may be incomplete or inaccurate. Reading and interpreting labels is assisted by AI providers described in our Privacy Policy.

Open Food Facts data is © its contributors and made available under the Open Database License (ODbL) v1.0; the licence text is at opendatacommons.org/licenses/odbl/1-0/ and the source database is at openfoodfacts.org. If you believe a product's data is wrong, please use the in-app report option so we can review and correct it.

What's free and what's paid

The current free plan includes 10 successful checks of different barcode products, 2 label-photo processing attempts and 2 new personal-analysis attempts per week. Product scores, additive information, your saved products and your scan history remain accessible without a subscription. Reopening a saved result does not use a new allowance.

Nutly Plus includes 100 different barcode-product checks per week, 25 label-photo processing attempts and 20 new personal-analysis attempts per calendar month. The updated Plus photo and personal-analysis allowances apply to all active subscriptions. The updated free photo and personal-analysis allowances apply to all accounts, including earlier app versions. The barcode allowances apply in current app versions. Plus is optional; the free plan remains available. Before purchase, the app shows the allowances for the offer you are buying.

Barcode checks count only when returned product data is usable for analysis, once per barcode in the same week. Incomplete data, pending reviews, missing products, non-food results and failed lookups do not consume barcode allowance. Reaching this allowance does not block label recognition when photo allowance remains; external barcode discovery stops at the cap. Label recognition and personal-analysis attempts use paid provider APIs: a new user-initiated processing attempt counts when processing starts, even if it fails. Internal provider retries and the background processing of that photo are included in the same attempt. A new manual attempt can consume another unit. Valid stored results are reused without a new processing charge.

When these updated limits are deployed, all accounts start with a fresh allowance once. Earlier promotional and one-time welcome allowances end, including any unused bonus. Weekly allowances then reset on Monday at 00:00 UTC. Monthly Plus AI allowances reset on the first day of each calendar month at 00:00 UTC, independently of the subscription billing date. Unused allowances do not roll over. Settings shows remaining allowances and reset dates. This allowance update does not change the price or billing schedule of an existing subscription; the billing, cancellation and refund terms below still apply.

Subscriptions and payment

Where available, Nutly Plus is an auto-renewing subscription purchased through Apple's App Store or Google Play. The store processes payment, provides purchase records and handles store refund requests under its own terms. Nutly provides the paid app features and does not receive your payment-card details.

The store purchase flow shows the price, currency, billing period, applicable taxes, and any introductory or trial terms before you confirm a purchase.

A subscription renews automatically unless cancelled under the store's rules. The store shows its renewal date and applicable price. Cancel before the store's renewal deadline to avoid the next charge; Apple and Google can have different billing and cancellation rules.

You cancel in your app store account settings — on Apple: Settings → your name → Subscriptions; on Google: Play Store → Payments and subscriptions. Deleting the Nutly app or erasing Nutly data does not cancel the subscription or stop billing. Cancel it separately in the store. After cancellation, paid access normally continues until the end of the period already paid for, subject to the store's rules and any refund.

Any free trial or introductory offer follows the terms shown by the store at purchase, including when paid billing begins and whether unused trial time is forfeited.

Request store refunds through Apple or Google under their applicable rules. This does not affect any statutory right of withdrawal or refund where you live; contact us if you need help exercising such a right.

If we change the price of an existing subscription, you will receive advance notice through the applicable store process and can cancel before the change takes effect. Where the law or store requires your explicit agreement to a price increase, renewal at that price is subject to that agreement.

When Nutly Plus ends, the free allowances apply. Ending a subscription does not itself delete your account, history, saved product results or health profile. Saved results remain accessible; the retention and deletion rules in our Privacy Policy still apply.

Availability and changes to the service

We may change, suspend, or discontinue any part of Nutly at any time, and we don't promise that it will always be available, uninterrupted, or error-free.

If we discontinue a paid feature or end Nutly Plus altogether, we'll give reasonable notice and arrange a pro-rata refund for a paid period you can no longer use through the applicable purchase channel. Your mandatory consumer rights still apply.

Disclaimers

To the fullest extent the law allows, Nutly is provided 'as is' and 'as available', without warranties of any kind, whether express or implied. We don't warrant that the service or its data will be accurate, complete, reliable, or fit for a particular purpose.

This does not exclude or limit any warranty or right that cannot be excluded under the law that applies to you, including your statutory consumer rights.

Our liability

To the fullest extent permitted by law, we won't be liable for indirect, incidental, special, or consequential loss, or for any loss arising from your reliance on Nutly's information, scores, or readings.

Nothing in these Terms limits our liability for death or personal injury caused by our negligence, for fraud, or for anything else that can't be limited under the law that applies to you — including your statutory rights as a consumer. Where our liability can be limited, our total liability to you is limited to EUR 100.

If your use causes a claim

If someone brings a claim against us because you broke these Terms or misused Nutly, you agree to cover the reasonable costs and damages we incur, to the extent the law allows. This does not apply to ordinary, good-faith use of the app.

Ending your use

You can stop using Nutly at any time, and erase your account and data yourself in Settings ('Erase my data') — see our Privacy Policy. We may suspend or end your access if you seriously or repeatedly break these Terms, or if we need to for legal or security reasons.

Sections that by their nature should continue — such as the disclaimers, our liability, and governing law — keep applying after your use ends.

Changes to these Terms

We may update these Terms as Nutly grows and publish a new version with an updated date. App releases containing a newer legal-document version ask you to review and accept it; an older installed app may not show that prompt until it is updated. Changes remain subject to your mandatory consumer rights.

Governing law and disputes

These Terms are governed by the laws of Ukraine, without affecting any mandatory consumer-protection rights you have where you live.

If you have a problem, please contact us first so we can try to resolve it. If we can't resolve it together, the dispute may be brought before the competent courts of Ukraine — again, without affecting any right you have to bring proceedings where your local consumer law requires.
