Terms of Service

These Terms of Service ('Terms') are an agreement between you and Yehor Hunko, a private entrepreneur (ФОП) registered in Ukraine ('Nutly', 'we', 'us'). They govern your use of the Nutly app and website.

By using Nutly, you agree to these Terms and to our Privacy Policy. If you don't agree, please don't use Nutly. We've written these Terms in plain language — and nothing in them takes away rights you have under mandatory consumer law.

Who we are

Nutly is operated by Yehor Hunko, a private entrepreneur (ФОП) registered in Ukraine. You can contact us about these Terms at privacy@nutly.cc.

Who can use Nutly

You must be at least 16 years old, or the minimum age of digital consent where you live, to use Nutly.

Some features — such as uploading a photo of an ingredients label — need your device's account, which the app creates automatically with nothing for you to register, and may be limited or change as we develop the app.

What Nutly does

Nutly helps you understand what's in packaged food. You scan a barcode; Nutly looks the product up, and if it isn't found you can photograph the ingredients label so we can read it. Nutly then identifies ingredients and additives and gives a health-related score.

We're still building Nutly, so features may change and the underlying data and scores will improve over time.

Information only — not medical or dietary advice

Nutly is for general information only. It is not medical, nutritional, or dietary advice, and it is not a substitute for reading the product's own label or speaking to a qualified professional.

Scores, ingredient readings, and additive information are generated automatically — including by optical character recognition and AI — and drawn from external databases, so they can be incomplete, out of date, or wrong. Always check the actual product packaging.

Never rely on Nutly for decisions about allergies, intolerances, medical conditions, or anything where a mistake could harm your health. If you have a food allergy or a medical condition, follow the product label and your healthcare provider — not Nutly.

Your account

Nutly creates an anonymous account for your device automatically the first time you open the app — no registration, no password, and we never ask for your name or email. It's what your subscription, usage limits, and health profile (if you set one up) live against.

That account is kept in your iCloud Keychain, so it carries over automatically to your other Apple devices and survives a reinstall, as long as you stay logged in to the same iCloud account with iCloud Keychain turned on. Without that, Restore purchases on a new device moves your subscription there instead. You're responsible for keeping your device secure, since anyone with access to it can use your account. You can erase it and start a fresh one at any time in Settings ('Erase my data').

Using Nutly responsibly

Please use Nutly fairly and lawfully. In particular, don't: break the law or infringe anyone's rights; access the service in unauthorised ways or try to break its security; reverse-engineer, copy, or resell the app; use bots, scrapers, or automated tools to harvest data or place excessive load; upload malware; or interfere with how Nutly works for other people.

Photos and reports you submit

When you submit a label photo or a product report, you confirm that you're allowed to share it and that it doesn't contain other people's personal data.

Label photos are used only to read the text and are not stored (see our Privacy Policy). Reports — the text you send us — are kept so we can review and improve product data. By sending a report, you give us a worldwide, royalty-free licence to use it to operate and improve Nutly. You keep ownership of what you submit.

Our content and intellectual property

Nutly — including the app, its design, the scoring method, and the Nutly name and logo — belongs to us or our licensors. We give you a personal, non-exclusive, non-transferable, revocable licence to use Nutly for your own, non-commercial purposes. We keep all rights we don't expressly grant you.

Third-party data and services

To identify and describe products, Nutly uses external sources, including Open Food Facts (made available under the Open Database License) and GS1 Ukraine. Data from these sources belongs to them, is subject to their own terms and licences, and may be incomplete or inaccurate. Reading and interpreting labels is assisted by AI providers described in our Privacy Policy.

Open Food Facts data is © its contributors and made available under the Open Database License (ODbL) v1.0; the licence text is at opendatacommons.org/licenses/odbl/1-0/ and the source database is at openfoodfacts.org. If you believe a product's data is wrong, please use the in-app report option so we can review and correct it.

What's free and what's paid

Scanning barcodes, seeing a product's score and additive breakdown, and your scan history are free, and we intend to keep them that way.

Two features cost us money every time you use them: reading a photo of an ingredients label, and generating a personal analysis against your health profile. These have a weekly allowance, which you can see at any time in Settings → Usage, and which resets every week.

We may offer an optional paid subscription — Nutly Plus — that raises those weekly allowances. It is never required to use Nutly. If and when you buy one, the section below applies.

Subscriptions and payment

Nutly Plus is sold as an auto-renewing subscription through the app store you installed Nutly from — Apple's App Store or Google Play. That store, not Nutly, is the seller: it takes your payment, issues your receipt, and handles refunds, under its own terms.

The price, the billing period, and any introductory or trial offer are shown in the app before you confirm the purchase, in your local currency and including applicable taxes.

Your subscription renews automatically for the same period at the then-current price, unless you cancel at least 24 hours before the current period ends. Your account is charged for the renewal within the 24 hours before the current period ends.

You cancel in your app store account settings — on Apple: Settings → your name → Subscriptions; on Google: Play Store → Payments and subscriptions. Deleting the Nutly app, or erasing your Nutly data, does not cancel the subscription and does not stop the billing — you must cancel it in the store. Cancelling stops the next renewal; you keep Nutly Plus until the end of the period you have already paid for.

If we offer a free trial, any unused part of it is forfeited when you buy a subscription covering the same period, where the app store applies that rule.

Refunds are handled by Apple or Google under their own terms — please request one through the store you bought from. This does not affect any statutory right of withdrawal or refund you have as a consumer where you live; if such a right applies, contact us and we'll help you exercise it.

If we change the price of an existing subscription, we'll tell you in advance and you can cancel before the new price takes effect. Where the law or the app store requires your explicit consent to a price rise, we'll ask for it, and your subscription won't renew at the higher price without it.

When Nutly Plus ends, your account, your history, and your health profile stay exactly as they are — you simply return to the free weekly allowances. We don't delete anything you created because you stopped subscribing.

Availability and changes to the service

We may change, suspend, or discontinue any part of Nutly at any time, and we don't promise that it will always be available, uninterrupted, or error-free.

If we discontinue a paid feature, or end Nutly Plus altogether, we'll give you reasonable notice and, for a period you've paid for but can no longer use, a pro-rata refund through the app store.

Disclaimers

To the fullest extent the law allows, Nutly is provided 'as is' and 'as available', without warranties of any kind, whether express or implied. We don't warrant that the service or its data will be accurate, complete, reliable, or fit for a particular purpose.

This does not exclude or limit any warranty or right that cannot be excluded under the law that applies to you, including your statutory consumer rights.

Our liability

To the fullest extent permitted by law, we won't be liable for indirect, incidental, special, or consequential loss, or for any loss arising from your reliance on Nutly's information, scores, or readings.

Nothing in these Terms limits our liability for death or personal injury caused by our negligence, for fraud, or for anything else that can't be limited under the law that applies to you — including your statutory rights as a consumer. Where our liability can be limited, our total liability to you is limited to EUR 100.

If your use causes a claim

If someone brings a claim against us because you broke these Terms or misused Nutly, you agree to cover the reasonable costs and damages we incur, to the extent the law allows. This does not apply to ordinary, good-faith use of the app.

Ending your use

You can stop using Nutly at any time, and erase your account and data yourself in Settings ('Erase my data') — see our Privacy Policy. We may suspend or end your access if you seriously or repeatedly break these Terms, or if we need to for legal or security reasons.

Sections that by their nature should continue — such as the disclaimers, our liability, and governing law — keep applying after your use ends.

Changes to these Terms

We may update these Terms as Nutly grows. If we make material changes, we'll post the new version and, where appropriate, ask you to accept it before you keep using Nutly. Continuing to use Nutly after an update means you accept the updated Terms.

Governing law and disputes

These Terms are governed by the laws of Ukraine, without affecting any mandatory consumer-protection rights you have where you live.

If you have a problem, please contact us first so we can try to resolve it. If we can't resolve it together, the dispute may be brought before the competent courts of Ukraine — again, without affecting any right you have to bring proceedings where your local consumer law requires.
